HMRC Is Pressing.
We Know How to Respond.

HMRC is the single largest creditor in UK business insolvency. Tax arrears escalate faster than most directors expect — but HMRC debt is negotiable, enforcement can be challenged, and a well-structured proposal can give your business the breathing space it needs.

— what is company rescue

HMRC Moves Faster
Than Most Creditors.

Company rescue refers to a range of formal and informal procedures available to limited companies experiencing financial difficulty. The
goal is to preserve the business — or at least the viable parts of it — as a going concern, protecting jobs, client relationships, and the value built by its directors over time.

What matters is acting early, understanding your options accurately, and working with one of our Insolvency Practitioners, who is qualified, independent, and focused entirely on your position as a director.

Business Guardian has guided over 3,500 directors through some of the most difficult business situations imaginable. We have seen every scenario — and we know which tools work in each one.

An honest note: Some companies cannot be saved. We will tell you clearly if yours is one of them — and we will tell you the best route forward if it is. Our reputation depends on giving directors the truth, not on generating instructions.

—  What we handle

Every Type of

HMRC Pressure.

We advise on the full range of HMRC debt situations — from a first missed payment to a winding up petition already filed at court. No situation is too far gone for us to assess.

01

Time to Pay Arrangements

A structured agreement to repay HMRC tax arrears in monthly instalments — typically six to twenty-four months. We prepare and present proposals that HMRC accepts, covering VAT, PAYE, Corporation Tax, and Self Assessment.

Learn About TTPs

02

VAT Arrears

Missed VAT returns attract automatic penalties and escalate quickly to enforcement. We regularise filings, negotiate repayment of arrears, and propose TTP arrangements that prevent formal action while debt is cleared.

03

PAYE & NIC Arrears

Falling behind on payroll obligations can attract serious enforcement, including personal liability notices against directors. We advise on PAYE arrears, manage HMRC correspondence, and negotiate structured repayment.

Corporation Tax Debt

Corporation Tax debt arises when a profitable company has insufficient cash to pay its tax bill. We help directors understand their liability, engage with HMRC proactively, and structure a repayment plan where possible.

— directors get wrong

The Mistakes That
Cost Directors Most.

In our experience advising directors, the same patterns arise repeatedly when businesses fall behind with HMRC. Understanding these mistakes is the first step to avoiding them.

Ignoring letters

HMRC correspondence that goes unanswered is treated as
deliberate non-engagement and accelerates enforcement significantly.

Negotiating without support

HMRC follows structured processes and rejects poorly presented proposals routinely. A credible case requires professional preparation.

Continuing to trade into further debt

Directors who know the company is insolvent and continue accumulating HMRC debt risk wrongful trading liability

Attempting to dissolve to avoid HMRC

This is a criminal offence. HMRC will apply to restore the company and can pursue directors personally

Waiting on a winding up petition

Every day between receiving a petition
and acting narrows your options. There is no safe period to wait

— the right approach

HMRC Is Not
the Enemy,

Ignoring Them Is.

The most effective approach is always early engagement, honest financial disclosure, and a credible repayment proposal presented by professionals who understand HMRC's expectations. That is what we do — on every case, every time.

Can HMRC make me personally liable for my company's tax debts?

In most cases, company tax debts are the company's liability — not the director's. However, HMRC can pursue directors personally where they believe tax has been deliberately avoided, where a Personal Liability Notice has been issued, or where there is evidence of fraudulent conduct. We advise on personal liability risk at your first consultation.
