— what is company rescue
Not Every Insolvent
Company Is Beyond Rescue.
Company rescue refers to a range of formal and informal procedures
available to limited companies experiencing financial difficulty. The
goal is to preserve the business — or at least the viable parts of it —
as a going concern, protecting jobs, client relationships, and the
value built by its directors over time.
What matters is acting early, understanding your options accurately,
and working with an Insolvency practitioners who is qualified,
independent, and focused entirely on your position as a director.
Business Guardian has guided over 3,500 directors through some of
the most difficult business situations imaginable. We have seen
every scenario — and we know which tools work in each one.
The business is still generating revenue and has genuine customers
Financial problems are primarily historical — arrears rather than ongoing trading losses
The business has assets, contracts, or goodwill that would be lost in liquidation
Key creditors — including HMRC — are open to negotiation
— Our Vision
The Right Solution
for Your Situation.
Each rescue route serves a different set of circumstances. We assess your
position honestly and recommend the procedure that gives you the best
realistic outcome — not the one that generates the most fees.
01
Company Voluntary Arrangement
(CVA)
A formal agreement to repay a portion of debt over three to five years while the company continues trading. HMRC, trade creditors, and landlords can all be included. Requires 75% creditor approval.

02
Administration
Immediate legal protection from all creditor action. An appointed administrator manages the company's affairs and explores rescue, sale, or asset realisation — with a full moratorium from day one.

03
Pre-Pack Administration
A pre-agreed sale of the business and assets that completes on the day administration is announced. Trading continues without interruption. Compliant with SIP 16 — the business survives, the debt stays behind.

— Acting Early Matters
The Most Common Thing
Directors Tell Us:
"I Wish I'd Called Sooner."
The options genuinely are better when you act before enforcement begins. A
winding up petition that could have been resolved with a CVA proposal becomes
compulsory liquidation when left too long. Our first consultation is always free —
there is no cost to understanding your options.
— Our accreditation
Licensed. Regulated.
Accountable.
Whether a business can be rescued depends on the nature of the debt, the underlying trading performance, the attitude of creditors, and whether the causes of financial distress can be addressed. Business Guardian assess each case without pre-determined conclusions.
If rescue is not viable, we say so — and we tell you what the right alternative is. An orderly company closure often protects a director's interests more effectively than pursuing rescue at all costs.
An honest note: Some companies cannot be saved. We will tell you clearly if yours is one of them — and we will tell you the best route forward if it is. Our reputation depends on giving directors the truth, not on generating instructions.
— Rescue is likely viable where:
The business is still generating revenue and has genuine customers
The business has genuine customers and is still generating income — the problem is debt and cash flow, not the trading model.
The debt is historical
Arrears have built up — HMRC, rent, supplier credit — but the current trading is not generating further losses.
There is something worth saving
Assets, contracts, goodwill, skilled staff — value that would be destroyed by immediate liquidation.
Directors can commit to a plan
A credible, affordable repayment or restructuring plan is achievable if the cause of the distress can be addressed.
Key creditors are open to negotiation
HMRC and major creditors are pragmatic where proposals are credible and professionally presented.

— Common Question
Frequently Asked
Questions
Will my employees find out the company is in difficulty?
In many cases, no immediate disclosure is required.
Formal insolvency procedures may involve notifying certain parties, but the timing and extent of this depends on the route taken. Many solutions, such as early-stage advice or informal negotiations with creditors, are handled completely confidentially.
We always prioritise discretion and will guide you on the best approach to protect both your business and your team.
Can I still trade during Administration?
Yes, in most cases your business can continue trading during Administration.
The process is designed to protect the company from creditor pressure while a recovery plan is put in place. An appointed administrator will oversee operations and work to achieve the best outcome, whether that’s restructuring, sale, or stabilisation.
The goal is to give your business breathing space while maintaining value.
How long does a CVA take to arrange?
A Company Voluntary Arrangement typically takes between 2 to 6 weeks to put in place.
The timeline depends on the complexity of your business, the level of debt, and how quickly financial information can be gathered. Once proposed, creditors are given time to review and vote.
We manage the entire process efficiently to minimise disruption and move quickly towards a solution.
What happens to my personal liability as a director?
In most cases, directors are not personally liable for company debts.
However, there are exceptions. If you have signed personal guarantees or if there has been wrongful or fraudulent trading, you may have some exposure.
We assess your situation carefully and provide clear, honest advice so you understand exactly where you stand and how best to protect yourself.
Is company rescue more expensive than liquidation?
Not necessarily — it depends on the situation.
While rescue options like a CVA or Administration can involve structured costs, they are often designed to preserve the business and future income. Liquidation may appear simpler, but it brings its own costs and ends the business entirely.
We focus on the outcome, not just the cost, helping you choose the option that delivers the best long-term result.
What if rescue is not possible for my company?
If rescue is not viable, we will guide you through the most appropriate closure route.
This ensures you meet your legal obligations as a director while closing the business in a controlled and professional manner. The aim is to minimise stress, reduce risk, and bring the situation to a clear resolution.
You’ll have a structured plan, full support, and no uncertainty about what comes next.
